H.R. 6376 — Supporting Military Families Exposed to Toxic Substances Act

This section establishes eligibility for hospital care and medical services from the Department of Veterans Affairs (VA) for individuals who resided at, worked at, or were in utero (while their mother resided at or worked at) a location where VA has established a presumption of service-connection for veterans' illnesses or conditions under 38 U.S.C. chapter 11 (e.g., Camp Lejeune water contamination or radiation exposure sites), provided the individual demonstrates exposure to the same conditions as determined by VA. Such care is available only for covered illnesses or conditions (i.e., those presumptively service-connected for veterans at the location); is subject to appropriations; excludes illnesses from other causes per VA guidelines; and requires exhaustion of third-party claims (as under current VA law). (Thus, the provision extends VA health benefits, typically limited to veterans and certain dependents, to a broader class of exposed non-veterans at designated hazardous sites.) This section further directs the VA Secretary to submit reports to the congressional Veterans' Affairs Committees by December 31 of 2027, 2028, and 2029 on program usage since January 1, 2026—including individuals served, illnesses and locations treated, denials with reasons, and pending eligibility decisions.
