H.R. 6386 — Ensuring Predictable and Reliable Water Deliveries Act of 2025

This section requires the Secretary of State, not later than 180 days after enactment and annually thereafter, to report to the Senate Foreign Relations and House Foreign Affairs Committees on Mexico's water deliveries under the 1944 U.S.-Mexico Water Treaty (requiring 1,750,000 acre-feet from Rio Grande tributaries over five-year cycles), including (1) whether Mexico delivered at least 350,000 acre-feet in the prior calendar year, (2) Mexico's capacity to meet the full five-year obligation, and (3) Mexican economic sectors dependent on U.S. water deliveries or the treaty's six tributaries. If the report shows Mexico failed to deliver the annual minimum, the President must deny all non-treaty emergency water requests (i.e., special Colorado River deliveries to Tijuana under International Boundary and Water Commission minutes) and may limit or terminate U.S. engagement with the identified Mexican sectors, except to counter fentanyl, precursors, xylazine, and other synthetic drugs; the denial does not apply if the Secretary certifies every 120 days that the water addresses an ecological, environmental, or humanitarian emergency (not municipal, industrial, or routine needs) vital to U.S. national interests.
