H.R. 6393 — DSH in Tennessee Act

This section establishes a permanent Medicaid disproportionate share hospital (DSH) allotment for Tennessee beginning in FY2026 (previously $0 under the terms of the TennCare demonstration project, which converted DSH funding to regular Medicaid expenditures). For FY2026, the allotment equals Tennessee's DSH allotment under current paragraph (6)(A)(vi) for FY2015, increased in each succeeding fiscal year by the percentage change in the Consumer Price Index for All Urban Consumers (U.S. city average); for FY2027 and subsequent years, Tennessee is deemed a low-DSH state (i.e., a state with DSH expenditures below the national average per uninsured low-income individual) with its allotment increased accordingly under paragraph (5)(B)(iii). (DSH allotments cap federal funding available for supplemental Medicaid payments to hospitals serving disproportionate shares of low-income patients.)
