H.R. 6453 — ADA 30 Days to Comply Act

This section establishes a notice-and-cure prerequisite to private civil actions under ADA Title III (public accommodations) for failure to remove an architectural barrier to access in an existing public accommodation. To file suit, an aggrieved person must provide the owner or operator with written notice specific enough to identify the barrier—including details of the denial of access, property address, any prior request for assistance, and whether the barrier is permanent or temporary—and either (1) receive no written plan outlining removal improvements within 30 days, or (2) receive a plan but see no barrier removal (or substantial progress, if more time is needed due to circumstances beyond the owner's control) within 30 days after providing the plan. (Thus, owners or operators generally have 30 to 60 days to respond before facing litigation.)
