H.R. 6495 — Taxpayer Notification and Privacy Act

This section revises IRS third-party contact notice requirements under IRC §7602(c)—which generally requires notifying a taxpayer before contacting third parties (e.g., banks or employers) for information relevant to the taxpayer's tax liability—(1) to require notices, when the information sought relates to tax liability, has not been previously requested from the taxpayer, and could reasonably be provided by the taxpayer, to identify each specific item of information intended to be sought from such persons; and (2) to provide the taxpayer a reasonable opportunity and minimum period of 45 days (or longer if requested with reasonable cause) to respond before such contacts (previously, reasonable opportunity without a specified minimum). It also adds an exception to the specificity requirement if the Secretary determines the information is necessary from the third party. The changes apply to notices provided 12 months after enactment.
