H.R. 6521 — Immigration Court Due Process Protection Act of 2025

This section prohibits Department of Homeland Security (DHS) officers or agents from arresting or detaining individuals physically present at an Executive Office for Immigration Review (EOIR) immigration court facility for a hearing, or immediately upon their arrival or departure for such purpose, except pursuant to a judicial warrant. The restrictions apply to individuals without a final removal order or during pendency of appeals or motions to reopen, reconsider, or otherwise challenge such an order, with an exception for preventing imminent acts of violence or specific, articulable threats to life, public safety, or national security. Separately, the section prohibits DHS arrests or detentions of individuals at scheduled appointments or check-ins with DHS, or upon arrival or departure therefor, unless (1) approved in writing by a supervisory official at senior field management level specifying the legal basis, and (2) reported to the Inspector General within 30 days and included in the report required under section 3.

This section directs the Inspector General of the Department of Homeland Security to submit to Congress, one year after the effective date of this Act and annually thereafter, a report evaluating compliance with this Act by DHS officers and agents. The report must include (1) the number of attempted and completed arrests referred to in section 2, (2) the basis for each such arrest, (3) the procedural posture of each arrested individual's immigration case, and (4) steps taken by the Secretary of Homeland Security to ensure compliance, including guidance or training provided to DHS employees.
