H.R. 6582 — Flight Risk Reduction Act

This section amends the Bail Reform Act to add non-citizen or non-lawful permanent resident status as a basis for a pretrial detention hearing. It further establishes a rebuttable presumption that no condition or combination of conditions of release will reasonably assure such a defendant's appearance or the safety of any other person and the community, which the defendant must rebut by clear and convincing evidence, and specifies that ties to family or employment in the United States do not constitute grounds for rebuttal. (Thus, non-citizens and non-lawful permanent residents face a higher bar for pretrial release than other defendants.)
