H.R. 6624 — Biological Intellectual Property Protection Act of 2025

This section states the sense of Congress that the People's Republic of China poses grave national security threats to the United States by accessing sensitive U.S. data and intellectual property through a military-civil fusion strategy and laws (i.e., National Security Law of 2015, National Intelligence Law of 2017, Data Security Law of 2021, and Counterespionage Law revised in 2023) that compel cooperation from citizens and organizations; and that the United States should control exports of synthetic DNA and RNA sequences to foreign adversaries due to risks of biotechnology intellectual property theft.

This section directs the Secretary of Commerce to require, not later than one year after enactment, a license for the export, reexport, or in-country transfer to a foreign entity of concern of any digital sequence (i.e., binary file or digital representation of nucleotide identity, order, and modifications) of synthetic DNA or RNA designed by humans or artificial intelligence systems. The section excepts such information publicly available under Export Administration Regulations §734.3(b); defines synthetic DNA or RNA (i.e., recombinant, chemically synthesized, or replicating nucleic acids that can base-pair with natural ones); and defines foreign entity of concern (i.e., government entities of a foreign country of concern such as China or Russia, persons under their jurisdiction, or entities owned, directed, or controlled by them, with foreign country of concern as defined in 42 U.S.C. 19221(a)).
