H.R. 6633 — High-Capacity Grid Act

This section establishes a best-available transmission conductor standard under Section 205 of the Federal Power Act for public utilities' cost recovery of covered transmission projects (i.e., new facilities or modifications, upgrades, replacements, or reconductoring of existing facilities subject to FERC jurisdiction). It (1) defines a best-available transmission conductor as one providing the greatest feasible energy-carrying capacity, highest electrical efficiency, and mitigation of thermal sag at maximum capacity, as determined by FERC rule; (2) presumes use of such conductors to be prudent with just and reasonable costs in rate filings and proceedings; (3) presumes use of non-best-available conductors to be imprudent with unjust and unreasonable costs; and (4) directs FERC to promulgate implementing regulations within 180 days of enactment, including a methodology for determinations consistent with the criteria and providing for periodic technology-based updates. (Thus, the standard incentivizes advanced conductors in FERC-jurisdictional transmission projects by shifting the burden in prudence reviews.)
