H.R. 67 — Modernizing Retrospective Regulatory Review

This section directs the Director of the Office of Management and Budget (OMB), acting through the Administrator of the Office of Information and Regulatory Affairs, in consultation with the Director of the Government Publishing Office, Archivist, and Director of the Federal Register, to submit to the appropriate congressional committees (House Committee on Oversight and Government Reform and Senate Committee on Homeland Security and Governmental Affairs) a report within 180 days of enactment assessing the Federal Government's progress in making agency regulations available to the public in machine-readable format (as defined in 44 U.S.C. §3502) and regarding recognition of the electronic Code of Federal Regulations (eCFR) as an official legal edition. The section further directs the OMB Administrator to issue guidance within 18 months of enactment, informed by that report, on how agency heads can identify, procure, and use technology—including algorithmic tools and artificial intelligence—to conduct more efficient retrospective reviews (i.e., post-issuance reviews) of existing regulations, such as to identify obsolete, ineffective, burdensome, or redundant provisions and to train agency personnel. Additionally, the section requires each agency head (as defined in 44 U.S.C. §3502) to submit to the OMB Administrator and appropriate congressional committees, within two years of enactment, a plan with (1) a strategy for implementing the OMB guidance; (2) identification of regulations or categories required or appropriate for post-issuance review; and (3) any additional data or ex-post analysis; and to implement that strategy within 180 days of plan submission for any such reviews.
