H.R. 6721 — MAP for Care Act

This section establishes the Medicare Advance Directive Certification Program under Medicare Part B (i.e., a voluntary program to encourage eligible beneficiaries—those entitled to Part A or enrolled in Part B—to adopt and maintain certified advance directives, such as living wills or durable powers of attorney for health care, that are electronically stored, state-recognized, and offered by Secretary-accredited vendors). The Secretary must implement the program not later than five years after enactment, accredit qualifying advance directive vendors (or contract for such accreditation), notify eligible beneficiaries of the program during the annual coordinated election period, ensure HIPAA-compliant privacy and security with access limited to participants, authorized representatives, and providers, provide website links to state-specific statutory and alternative advance directive forms, and incorporate best practices for technology, education, and interoperability without preempting state law. (Thus, program participants may enroll, register directives indicating their storage or access location, and disenroll at any time.)
