This section excludes from countable income under the Supplemental Security Income (SSI) program—any amounts received by an SSI recipient (or spouse) in settlement of a claim for personal injury, physical sickness, or damage to or depreciation of property, including settlements from the East Palestine Train Derailment case (In re: East Palestine Train Derailment, No. 4:23-CV-00242, N.D. Ohio)—by adding new paragraph (27) to Section 1612(b) of the Social Security Act. It similarly excludes such amounts from countable resources for the month of receipt and all subsequent months by adding new paragraph (18) to Section 1613(a). (SSI provides monthly cash benefits to low-income aged, blind, or disabled individuals, with eligibility limited by income and resource tests.) The exclusions apply to benefits for months beginning on or after enactment and, for the specified East Palestine settlements received before enactment, retroactively to previously paid benefits.
