H.R. 675 — Domestic SUPPLY Act of 2025

This section establishes the National Defense and Health Security Domestic Manufacturing Partnership Program, under which the Secretary of Health and Human Services (HHS), in collaboration with the Assistant Secretary for Preparedness and Response, CDC Director, and in coordination with the Secretaries of Defense and Homeland Security, enters into partnerships with eligible domestic manufacturers to ensure availability of qualified personal protective equipment (PPE) for public health emergencies declared under section 319 of the Public Health Service Act. It directs HHS to finalize, not later than one year after enactment, a process for contractual purchasing agreements that (1) guarantee specified supplies and manufacturing lines of qualified PPE and (2) fulfill other emergency-related requirements designated by HHS. It specifies eligibility for domestic manufacturers, which must (1) be headquartered in the continental United States; (2) manufacture 50% of products supplied to the federal government in the continental United States in 2026, 75% in 2027, and 100% by 2028; (3) be majority owned and operated by U.S. citizens; (4) have supply agreements verifying supply chain security and sourcing; and (5) attest that their products meet CDC and OSHA quality guidelines. It requires HHS to maintain a list of qualified PPE, which must (1) meet CDC and OSHA quality guidelines; (2) be cleared under FDA section 510(k) premarket notification; and (3) be priced using HHS fair-market benchmarks.

This section prohibits agencies of the federal government or of a state or local government from using federal funds on or after enactment to procure clothing or equipment used to prevent the transmission of infectious disease if manufactured outside the United States. The prohibition is subject to the exceptions in 41 U.S.C. 8302(a)(2)(A) (articles, materials, or supplies for use outside the United States) and (B) (procurements pursuant to a reciprocal defense procurement memorandum of understanding or certain trade agreements); use of an exception requires the responsible official to submit documentation, including a detailed justification.

This section directs the Secretary of Health and Human Services, in consultation with the Assistant Secretary of Labor for Occupational Safety and Health, to submit to Congress, not later than one year after enactment, a report on (1) changes to federal requirements applicable to personal protective equipment (PPE) since the beginning of the COVID-19 pandemic and (2) the impact of those changes on the safety of physicians and other medical professionals caring for patients face-to-face during 2020 and 2021.
