§2. Availability of opioid antagonists
This section establishes requirements for the Director of the Bureau of Prisons to maintain opioid antagonist kits (i.e., FDA-approved medications such as naloxone that reverse opioid overdose effects, packaged with overdose recognition guidance) at each federal correctional facility. The kits must be available in medical housing units, staff breakrooms, visiting areas, living quarters, recreation spaces, dining halls, housing units, work and program locations, hallways, corridor posts, security checkpoints, inmate congregation areas, and educational and religious areas; stored securely at room temperature out of direct sunlight; accessible to incarcerated persons for overdose response; and regularly checked for expiration and replaced as needed.
The section further requires (1) annual training by medical staff for BOP personnel (i.e., correctional officers, medical staff, counselors, and other employees) and incarcerated persons on opioid antagonist administration and overdose recognition; (2) documentation of each administration, including location, time, recipient's name, administrator's name and title, and recipient's status; (3) immunity from liability for incarcerated persons administering kits in good faith; and (4) annual reports to Congress on kit availability by facility, overdose incidents, trainings conducted, and expired kits.
The section authorizes appropriations of $6 million for FY2026 (for training, kit purchases, and the initial report) and $2 million annually for FY2027 and FY2028 (for kit maintenance, training, and reporting).
