This section directs the Secretary of Transportation to issue, not later than one year after enactment, regulations requiring air carriers to provide compensation to passengers on domestic or international flights experiencing a significant delay or cancellation due to circumstances within the carrier's control that result in arrival at the destination more than three hours after the original scheduled time, as follows: (1) up to $300 for arrival more than three but less than nine hours late, and (2) up to $775 for arrival nine or more hours late. In either case, if a connecting flight is missed due to the disruption, the carrier must provide booking on the next available flight at no additional cost. These compensation requirements are separate and distinct from airline refund obligations under 49 U.S.C. 42305 (i.e., refunds for passengers holding nonrefundable tickets who choose not to travel on a cancelled or significantly delayed/changed flight).
