This section eliminates eligibility for any federal public benefit for all aliens—notwithstanding prior law limiting ineligibility to non-qualified aliens (as previously defined)—by (1) revising 8 U.S.C. 1611(a) to apply the prohibition to any alien (as defined in INA §101); (2) repealing 8 U.S.C. 1611(b), which provided exceptions such as emergency Medicaid (i.e., treatment for emergency medical conditions excluding organ transplants), short-term non-cash disaster relief, public health assistance for immunizations and communicable disease testing/treatment, Attorney General-designated in-kind community services (e.g., soup kitchens, crisis counseling), and certain pre-August 22, 1996, housing assistance; (3) expanding the definition of federal public benefit in 8 U.S.C. 1611(c) to explicitly include cash assistance; (4) repealing the definition of qualified alien at 8 U.S.C. 1641; and (5) repealing 8 U.S.C. 1613 (previously limiting certain qualified aliens' eligibility for five years). (Thus, no alien may receive any federal public benefit, including those previously excepted.)
