H.R. 6871 — Preventing the Recognition of Terrorist States Act of 2025

This section states U.S. policy (1) not to recognize the Islamic Emirate of Afghanistan, controlled by the Taliban, as the official government of Afghanistan under any circumstances; (2) to view the Taliban's takeover of Afghanistan as a coup d'état and therefore illegitimate; and (3) to recognize that U.S.-designated terrorists, such as Sirajuddin Haqqani, play a key role in the Taliban regime.

This section prohibits federal departments and agencies from taking any action or extending assistance that states or implies recognition of the Taliban's claim of sovereignty over Afghanistan. It further prohibits the obligation or expenditure of funds appropriated for the Department of State, USAID, or Department of Defense on or after enactment to prepare, promulgate, implement, administer, or enforce any policy extending diplomatic recognition to the Islamic Emirate of Afghanistan.

This section directs the Secretary of State to designate the Islamic Emirate of Afghanistan as a state sponsor of terrorism (i.e., a country the government of which has repeatedly provided support for acts of international terrorism, for purposes of section 620A of the Foreign Assistance Act of 1961 (22 U.S.C. 2371), section 40(d) of the Arms Export Control Act (22 U.S.C. 2780(d)), section 1754(c)(1)(A)(i) of the Export Control Reform Act of 2018 (50 U.S.C. 4813(c)(1)(A)(i)), and any other provision of law). (Thus, this triggers prohibitions on U.S. foreign assistance under the Foreign Assistance Act, arms exports and sales under the Arms Export Control Act, certain export controls, and related restrictions.)
