H.R. 6882 — SAFE Services Act

This section directs the Secretary of Defense, not later than 180 days after enactment, to revise the Department of Defense Supplement to the Federal Acquisition Regulation to require contracting officers—to the maximum extent practicable and consistent with national security—to give a preference to United States companies for contracts procuring professional services (i.e., engineering, architecture, design, environmental consulting, financial consulting, program management, legal services, and other services as defined in the Federal Acquisition Regulation). It authorizes the Secretary to waive the preference if adherence would prevent meeting an urgent operational requirement or no United States company can fulfill contract requirements in a timely or cost-effective manner, requiring any waiver to be issued in writing with justification and notice provided to the congressional defense committees not later than 30 days after issuance. It defines a "United States company" as a business entity organized under the laws of a state, territory, possession, or the District of Columbia; with its principal place of business in the United States; and not directly or indirectly owned or controlled by a foreign entity (including a joint venture in which such an entity holds at least 50% ownership).
