H.R. 6936 — ___ Act

This section requires voters in federal elections to present government photo identification—defined as a valid photo ID card issued by federal, state, or tribal government showing the voter's photo, full name, and date of birth—and proof of U.S. citizenship (e.g., passport, certified birth certificate, naturalization certificate) as a condition of receiving a ballot, either in person or by mail (with copies of documents submitted alongside absentee ballots). Voters lacking such documentation may cast a provisional ballot under Help America Vote Act section 302(a), which is counted only if state officials verify U.S. citizenship; name discrepancies may be resolved with documents such as marriage certificates or court orders. (As background, the Help America Vote Act of 2002 established minimum standards for voting systems, provisional voting, and voter access to prevent disenfranchisement.) This section further amends the criminal prohibitions in 52 U.S.C. 20511 (Voting Rights Act) by adding as new violations (1) providing material assistance to a noncitizen attempting to vote in a federal election and (2) providing a ballot to an individual who fails to present government photo identification and proof of U.S. citizenship, retaining existing penalties of a fine, imprisonment for up to five years, or both.
