H.R. 6951 — Stop Unfair Medicaid Recoveries Act

This section limits Medicaid liens on the real property of institutionalized individuals (i.e., those in nursing facilities or similar institutions required to spend most income on care and unlikely to return home) to those imposed before enactment; requires states to withdraw any such liens in effect as of enactment within 90 days and notify affected individuals or their representatives; prohibits adjustments or recoveries of correctly paid medical assistance on or after enactment (previously required from estates of deceased recipients); and requires states to withdraw related liens within 90 days and provide notification. (As background, these provisions comprise the Medicaid estate recovery program, which recovers long-term care costs from beneficiaries' estates after death. Thus, states may no longer impose new liens or pursue recoveries post-enactment.)
