This section authorizes the Secretary of Transportation to establish a nonprofit corporation, owned by the United States and organized under New York law as a 501(c)(3) tax-exempt entity, to support the athletic programs of the United States Merchant Marine Academy through charitable, educational, and civic purposes. The section further (1) limits board members to uncompensated service (except travel expenses) with no more than one-third Department of Transportation employees for oversight; (2) authorizes the Secretary to enter contracts and cooperative agreements with the corporation, including sole-source awards and property acquisitions; (3) permits leasing academy real property to the corporation for up to five years if not needed for academy use, with proceeds retained for athletic support; (4) allows the Secretary to provide essential support services (e.g., utilities, security) without U.S. liability; (5) directs transfer of nonappropriated fund assets (except real property) to the corporation; and (6) enables acceptance of funds, supplies, and services from the corporation or other sources (e.g., NCAA, game guarantees).
