This section requires each data center located in the United States to generate all electricity it consumes annually, with not less than 75% from clean energy sources (i.e., solar, wind, battery, green hydrogen, hydropower, or geothermal) during 2035 through 2039, increasing to 100% beginning January 1, 2040. The section applies the requirement to data centers—as defined in existing law (42 U.S.C. 17112(a)(1)) for a voluntary national program on data center energy efficiency—that consume at least 50 megawatts daily. It imposes civil penalties of up to $100,000 per day for violations and requires the Secretary of Energy to establish an administrative enforcement process within 30 days of enactment.
