This section directs the Administrator of the Federal Railroad Administration to submit to Congress, not later than 18 months after enactment, a report on the rate and causes of rail tank car pressure relief device failures in derailment events—including variables such as number of tank cars involved, fire presence and conditions (temperature and duration), time and circumstances before failure, and for each failed device an assessment of commodity compatibility, thermal protection survivability, and orientation (above or below vapor line or in liquid space)—along with (1) recommendations to prevent such failures and (2) the status of unimplemented National Transportation Safety Board recommendations on rail tank cars. In developing the report, the Administrator must consult with the Pipeline and Hazardous Materials Safety Administration, rail employers, organizations representing rail employees, and rail tank car builders, shippers, and owners.
