H.R. 7022 — Mystic Alerts Act

This section directs the Federal Communications Commission (FCC), in consultation with the Department of Homeland Security (DHS) and the Federal Emergency Management Agency (FEMA), to issue a notice of proposed rulemaking within 6 months of enactment and a final rule within 18 months of enactment to establish requirements facilitating satellite transmission of emergency alerts under the Warning, Alert, and Response Network Act (i.e., Wireless Emergency Alerts (WEA) delivered to commercial mobile service (CMS) subscribers' devices). The final rule's effective date is the later of 36 months after its Federal Register publication or 12 months after DHS and FEMA notify the FCC of implementing necessary standards, protocols, or procedures. **(2)** Covered CMS providers (i.e., those voluntarily electing WEA participation and offering satellite voice and data services to subscribers) must file an election with the FCC within 60 days after the final rule's effective date on whether to transmit WEA by satellite to capable subscriber devices, in addition to cell broadcast transmission. Providers electing to transmit must notify the FCC, comply with FCC technical standards, honor WEA opt-outs, and impose no extra charge; those electing not to transmit must notify new and existing subscribers as required under current WEA rules. **(3)** This section provides liability immunity for covered CMS providers (and their officers, directors, employees, vendors, and agents) for acts or omissions in satellite WEA transmission or related release of subscriber information to government or public safety entities, regardless of transmission election.
