This section establishes a new section 7314 in 5 U.S.C. Chapter 73 that makes individuals finally convicted of a crime of violence by any federal, state, or local court ineligible to accept or hold civil service positions and requires their removal if employed at the time of final conviction. It defines crime of violence using 18 U.S.C. §16(a) (i.e., offenses with an element of the use, attempted use, or threatened use of physical force against the person or property of another), excluding the residual clause in §16(b).
This section prohibits the federal government from entering into contracts with covered individuals—those finally convicted of a crime of violence—or with any entity in which such an individual holds a covered position (i.e., providing goods or services under a federal contract, serving as an officer or director, or holding a controlling ownership interest). It further requires agency heads to include in contracts a clause barring covered individuals from working on the contract. (A crime of violence is defined in 18 U.S.C. §16(a) only (i.e., offenses with an element of the use, attempted use, or threatened use of physical force against the person or property of another), excluding the residual clause in §16(b).) The Director of the Office of Management and Budget may waive these prohibitions if termination of a contract or barring an individual would impose a unique or undue burden on the government; the prohibitions apply to contracts entered into before, on, or after enactment; and the Federal Acquisition Regulation must be revised within six months of enactment to implement these requirements.
