H.R. 7068 — No Convicts Running the Capital Act

This section prohibits the District of Columbia government from appointing or retaining individuals finally convicted of a crime of violence or a dangerous crime. It (1) bars appointments after enactment unless the individual certifies no such conviction, and (2) requires termination of any such current employees within 90 days of enactment.

This section prohibits District of Columbia government offices from entering into contracts for goods or services with a covered vendor unless the vendor certifies it is not covered. A covered vendor is (1) an individual finally convicted of a crime of violence or dangerous crime or (2) an entity that employs such a convicted individual to perform under the contract, has such an individual as an officer or director, or has such an individual with a controlling ownership interest. The prohibition applies to contracts entered into after enactment, and requires termination of any existing contracts with covered vendors within 90 days of enactment.

This section establishes definitions for purposes of the Act: (1) “crime of violence” as defined in D.C. Official Code §23–1331(4), including substantially similar offenses under federal, state, or local law; (2) “dangerous crime” as defined in D.C. Official Code §23–1331(3), including substantially similar offenses under federal, state, or local law; and (3) “finally convicted” as a conviction that has not been appealed or is no longer appealable, or whose appeals process is completed.
