This section directs the Secretary of Defense, acting through the Office of Small Business Programs, to conduct a study reviewing Department of Defense contracts awarded at or below the simplified acquisition threshold (as defined in 10 U.S.C. 3015)—typically $250,000 domestically, or two times that amount for contracts awarded and performed outside the United States in support of a contingency operation or humanitarian or peacekeeping operation—to assess compliance with small business set-aside requirements. Not later than 180 days after enactment, the Secretary must submit a report on the study to the House and Senate Armed Services Committees and the House Small Business Committee and Senate Small Business and Entrepreneurship Committee that includes (1) total dollar amounts of such contracts over the prior five years, including percentages and aggregate amounts awarded to small business concerns; (2) an overview of contract types, products, and services not awarded to small business concerns; (3) reasons such contracts may not be set aside; (4) trends or patterns in awards to non-small business concerns that should have been set aside; and (5) recommendations for statutory, regulatory, policy, or guidance changes.
