H.R. 7102 — Federal Workforce Civics Competency and Accountability Act

This section establishes a citizenship test requirement—based on the naturalization test administered under section 312(a)(2) of the Immigration and Nationality Act (i.e., 100 civics questions)—for appointment to and continued employment as a career employee, defined as an employee in the competitive service or a career appointee in the Senior Executive Service (excluding confidential, policy-determining, or policy-making excepted positions). Specifically, the section (1) renders individuals ineligible for appointment to competitive service positions or as career appointees if they fail the full citizenship test (requiring at least 90% correct); (2) requires current career employees, as a condition of continued employment, to pass the full test within one year of enactment; and (3) mandates annual testing for all career employees using 20 randomly selected questions (requiring 15 correct), with failure triggering a full re-test and potential discipline up to removal. The Office of Personnel Management (OPM), in consultation with U.S. Citizenship and Immigration Services, must administer the test (full version for appointments, initial testing, and re-tests; 20-question version annually), maintain related electronic systems, provide study materials and training, and submit annual reports to Congress on compliance, results, and disciplinary actions.
