This section establishes continued entitlement to Social Security Disability Insurance (SSDI) benefits for individuals whose disability is attributable to an injury for which they received the Purple Heart, without regard to the termination month following substantial gainful activity (SGA). Instead of termination, such benefits are reduced by $1 for each $4 of monthly earnings exceeding the SGA threshold under subsection (d)(4)(A) (not below $0), with proportional reductions to any auxiliary benefits payable under section 202; the amendments apply to benefits for months beginning 6 months after enactment. (As background, SSDI benefits for non-veterans generally end after a 9-month trial work period and 36-month extended eligibility period if the recipient engages in SGA.)
This section expands eligibility for the higher substantial gainful activity (SGA) threshold applicable to blind individuals receiving disability insurance benefits (DIB) (i.e., Social Security Disability Insurance) to also include DIB recipients entitled under subsection (a)(1) based on a disability attributable to an injury for which they were awarded the Purple Heart. The change applies to benefits payable for months beginning 6 months after enactment.
