H.R. 7123 — Abolish ICE Act

This section states 10 congressional findings criticizing U.S. Immigration and Customs Enforcement (ICE), including its mission design prioritizing enforcement over due process; mass arrests of noncriminals (approximately 70% of 2025 arrests); specific 2025-2026 raids and incidents resulting in deaths (e.g., 360 arrests and 1 death at Camarillo cannabis farms; shootings of Silverio Villegas Gonzalez, Keith Porter Jr., and Renee Nicole Good; military-style raid in Chicago); 32 inmate deaths in ICE detention in 2025; and detention of as many as 170 U.S. citizens, and concludes that ICE is unbound by the rule of law, beyond reform, and must be abolished.

This section prohibits Federal funding for all functions, duties, and responsibilities of U.S. Immigration and Customs Enforcement (ICE)—the Department of Homeland Security component responsible for interior immigration enforcement, detention and removal operations, and investigations of cross-border crime—beginning on the date of enactment. It rescinds all unobligated balances of ICE funds available as of the day before enactment and transfers ICE's other assets and liabilities to the Secretary of Homeland Security. The section abolishes ICE effective 90 days after enactment.
