H.R. 7128 — TRIA Program Reauthorization Act of 2026

This section amends the criteria under the Terrorism Risk Insurance Act of 2002 for excluding an event from certification as an "act of terrorism" (i.e., triggering the federal reinsurance backstop for terrorism insurance losses). Specifically, it (1) increases the minimum insured loss threshold for exclusion to $10 million (from $5 million) for acts occurring in 2029 or later; (2) adds an exclusion if the Secretary of the Treasury does not certify the act within 90 days after publishing notice in the Federal Register; and (3) requires the Secretary to publish notice in the Federal Register no later than 30 days after beginning the certification determination process and permits additional public notices, including that an act is not under evaluation.

This section amends Section 103(e)(7)(E)(i) of the Terrorism Risk Insurance Act of 2002 by extending multiple dates as follows: (1) in subclause (I), to 2029 (from 2022) and 2031 (from 2024); (2) in subclause (II), to 2030 (from 2023), 2036 (from 2029), and 2031 (from 2024); and (3) in subclause (III), to 2036 (from 2029) and 2031 (from 2024). The section also makes a technical correction throughout the Act by replacing "Terrorism Insurance Program" with "Terrorism Risk Insurance Program".
