H.R. 7172 — TRACK ICE Act

This section limits eligibility for withholding of aircraft registration numbers and personally identifiable information under 49 U.S.C. 44114(a) and (b) by excluding any private aircraft operation that is (1) operated by, under contract or subcontract with, or on behalf of U.S. Immigration and Customs Enforcement or Customs and Border Protection; (2) used for detention, deportation, or transport of individuals in the custody of the Secretary of Homeland Security in connection with enforcement of the immigration laws; and (3) receives federal funding or other financial assistance for such operation.

This section directs the Secretary of Homeland Security to publish flight data for each aircraft operation carried out by the Department of Homeland Security (including U.S. Immigration and Customs Enforcement or Customs and Border Protection) or the Coast Guard for the purpose of detention, deportation, or transport of individuals in custody in connection with immigration law enforcement not later than 72 hours after the operation, in a manner accessible to the public. Flight data includes (1) date and time of departure at origin airport and arrival at destination airport; (2) origin and destination airports' International Civil Aviation Organization (ICAO) codes and ICE Air mission designation; (3) aircraft registration number and ICAO aircraft identification code; (4) number of individuals detained by ICE or another immigration enforcement agency who boarded and deplaned at each location; and (5) demographic data for each detainee on each flight leg (by ICAO airport codes), including nationality, sex, age category (0–10; 11–17; 18–50; 51+), family composition category (single adult, unaccompanied child, or family unit), and type and quantity of restraints used (e.g., handcuffs, shackles on arms and legs, or full-body restraint device).
