H.R. 725 — Crow Revenue Act

This section defines terms for purposes of the Act, including (1) "Bull Mountains Lease" as Bureau of Land Management Lease MTM–97988 dated June 1, 2012; (2) "Bull Mountains Mineral Tracts" as approximately 4,530 acres of U.S.-owned subsurface mineral interests in specified sections of Musselshell County, Montana; (3) "Bull Mountains Surface Tracts" as approximately 940 acres of U.S.-owned surface interests in specified sections of Musselshell County, Montana; (4) "Hope Family Tracts" as approximately 4,660 acres of mineral interests owned by the Hope Family Trust in specified sections of Big Horn County, Montana, within the Crow Reservation; (5) "Hope Family Trust" as the Joe and Barbara Hope Mineral Trust; (6) "Lessee" as the lessee of the Bull Mountains Lease; (7) "Musselshell Resources LLC" as the Musselshell Resources Limited Liability Company registered in Montana; (8) "Musselshell Resources Tracts" as approximately 959 acres of surface interests owned by Musselshell Resources LLC in specified locations in Musselshell County, Montana; (9) "Secretary" as the Secretary of the Interior; (10) "State" as Montana; and (11) "Tribe" as the Crow Tribe of Montana. All tracts are generally depicted on specified maps.

This section directs the completion, not later than 60 days after enactment and in a single transaction, of an exchange of mineral interests as follows: (1) acceptance by the Secretary of the Interior of any offer by the lessee to relinquish the Bull Mountains Lease, notwithstanding specified regulations; (2) conveyance by the Hope Family Trust to the Tribe of all mineral interests in the Hope Family Tracts; and (3) conveyance by the United States to the Hope Family Trust, subject to valid existing rights and upon lease relinquishment, of all federal mineral interests in the Bull Mountains Mineral Tracts. On the Tribe's request, the mineral interests conveyed to it shall be taken into trust by the United States for the Tribe's benefit and shall be exempt from state and local taxation. Prior to those conveyances, the tracts involved shall be withdrawn from entry, appropriation, disposal under public land laws, mining laws, and mineral leasing laws (subject to valid existing rights); additionally, the Tribe must notify the Secretary that it and the Hope Family Trust have agreed to a revenue-sharing formula for any future development of the mineral interests conveyed under paragraph (3).

This section directs a land exchange in a single transaction not later than 60 days after enactment, whereby (1) Musselshell Resources LLC conveys to the United States all right, title, and interest in the surface interests of the Musselshell Resources Tracts; and (2) subject to valid existing rights, the Secretary conveys to Musselshell Resources LLC all right, title, and interest of the United States in the surface interests of the Bull Mountains Surface Tracts.

This section prohibits the reduction or denial of any other federal services, benefits, or programs to the Tribe or its members due to amounts or benefits received under this Act, based on (1) the Tribe's status as a federally recognized Indian tribe or (2) a member's status as a tribal member.
