This section transfers the transit-oriented development pilot program from section 20005(b) of the Federal Public Transportation Act of 2012 (49 U.S.C. 5303 note)—which supports planning grants to promote transit-oriented development (TOD), i.e., higher-density development near transit stations to increase ridership and reduce driving—to a new subsection (s) of 49 U.S.C. §5303 and redesignates it as a grant program. It (1) expands eligible projects to include new fixed guideway capital projects, fixed guideway bus rapid transit projects, or corridor-based capital investments in existing fixed guideway systems (from new fixed guideway capital projects or core capacity improvement projects); (2) defines predevelopment activities to encompass planning, site evaluation, engineering and architectural design, community engagement, feasibility studies, utility coordination, accessibility assessments, and site preparation for TOD; (3) adds as eligible activities support for predevelopment and improvements to transit and TOD site access for all users, including individuals with disabilities, seniors, veterans, and transit-dependent populations via paratransit and bicycle infrastructure; and (4) authorizes $75 million for each of FY2027 through FY2031, in addition to appropriations under 49 U.S.C. §5338.
