H.R. 7356 — No Federal Funds for Ballot Harvesting Act

This section establishes the short title of the Act as the "No Federal Funds for Ballot Harvesting Act" and states congressional findings that (1) voting is a fundamental right; (2) reports documented non-voters depositing large numbers of absentee ballots at polling places, known as ballot harvesting; (3) such practices create chain-of-custody vulnerabilities due to lack of collector identification and tracking; (4) they enable electioneering and undue influence at voters' homes; and (5) the Supreme Court has upheld state authority to restrict them.

This section prohibits federal funds under the Help America Vote Act of 2002 (HAVA)—which provides grants to states for improving election administration and voter access—from being used to administer federal elections in states lacking a law that bans the knowing collection and transmission of another person's mailed ballot by anyone other than (1) an election official in official duties, (2) a U.S. Postal Service or common carrier employee in authorized duties, (3) another individual authorized by law to handle U.S. mail in official duties, or (4) the ballot recipient's family member, household member, or caregiver. (Thus, states permitting "ballot harvesting" by other third parties lose eligibility for such funds.)
