H.R. 7359 — Somalia Immigration Moratorium Act

This section states congressional findings on the purpose of the U.S. government to ensure national survival and security as a sovereign republic securing citizens' natural rights and prioritizing their wellbeing and interests, as well as the government's sovereign right to admit or deny entry to foreign persons. The section declares the purpose of the Act to be establishing a moratorium on immigration concerning citizens and nationals of Somalia.

This section amends the Immigration and Nationality Act (INA) as follows: (1) inserts new INA section 212(a)(11) to prohibit issuance of any visa or provision of any immigration status to nationals of Somalia for 25 years following enactment of the Somalia Immigration Moratorium Act (notwithstanding any other provision of law), except for (a) aliens lawfully admitted to the United States prior to enactment, (b) lawful permanent residents, and (c) aliens traveling on valid nonimmigrant visas in A-1, A-2, C-2, C-3, G-1, G-2, G-3, or G-4 classifications (with such exceptions made solely by the Secretary of State, or designee, in coordination with the Secretary of Homeland Security, or designee); and (2) inserts new INA section 241(b)(3)(D) to render citizens or nationals of Somalia ineligible for withholding of removal (i.e., prohibition on removal to a country where an alien's life or freedom would be threatened on protected grounds).

This section includes a standard severability clause, providing that if any provision of the Act or its amendments is held unconstitutional as applied to any person or circumstance, the remainder of the Act and its amendments remain in effect.
