H.R. 7366 — Dietary Supplement Regulatory Uniformity Act

This section establishes federal preemption under the Federal Food, Drug, and Cosmetic Act (FD&C Act) over state or local requirements on dietary supplements (i.e., products such as vitamins, minerals, herbs, or amino acids intended to supplement the diet) that differ from, are in addition to, or are not identical to federal requirements. It directs the Secretary of Health and Human Services to exempt, by regulation after notice and hearing, any such state or local requirement that is more stringent than federal law or that addresses a compelling local condition without causing noncompliance with federal law.
