H.R. 7371 — No Flight, No Fight Act of 2026

This section sets forth congressional findings on the critical role of civil aviation in the U.S. economy; unique aviation safety, biosecurity, and operational challenges posed by air transport of adult roosters, including links to illegal cockfighting; benefits of restricting non-essential shipments while exempting commercial poultry operations; and FAA and DOT authority over civil aviation safety and cargo regulation.

This section prohibits air carriers and other persons operating aircraft in interstate or foreign air transportation from knowingly transporting adult roosters (i.e., male chickens at least six months old with signs of sexual maturity) as cargo, except for transport to or from a commercial farm (i.e., with $350,000 or more in annual gross cash farm income, per Economic Research Service classifications) for legitimate agricultural purposes if certified in advance with required documentation. It defines relevant terms and makes a conforming amendment to the table of contents for 49 U.S.C. chapter 449.

This section directs the Secretary of Transportation, in coordination with the Federal Aviation Administration, to enforce this Act and its amendments, authorizes promulgation of necessary regulations, and subjects violations to civil penalties under 49 U.S.C. chapter 463.

This section provides a rule of construction clarifying that nothing in this Act preempts state laws that provide greater protections for aviation safety or impose stricter restrictions on the air transportation of live animals.
