This section amends Section 301 of the Federal Food, Drug, and Cosmetic Act (21 U.S.C. 331) to establish two new prohibited acts: (1) the introduction or delivery for introduction into interstate commerce of any product marketed as a dietary supplement (i.e., a product intended to supplement the diet containing dietary ingredients such as vitamins, minerals, herbs, or amino acids) that does not meet the definition of a dietary supplement under Section 201(ff); and (2) the introduction or delivery for introduction into interstate commerce of a dietary supplement that has been prepared, packed, or held using the assistance of, or at the direction of, a person debarred under Section 306 (i.e., typically for felony convictions relating to adulterated or misbranded drugs). It also makes conforming amendments to (1) Section 801(a) to authorize refusal of admission for imports violating these new provisions and (2) Section 304 to extend seizure authority to such products.
