H.R. 7421 — SAFE Olympic Sports Act

This section revises the eligibility criteria for certification as a national governing body (NGB) by inserting an exception in paragraph (15) for a new sex-based participation requirement, making grammatical changes to paragraphs (18) and (19), and adding paragraph (20) to require NGBs to limit amateur athletes' participation in the Olympic Games, Paralympic Games, Pan American Games, Parapan American Games, or any other event or competition they sanction (including national, regional, state, or local divisions) to those corresponding to the athlete's biological sex. (NGBs are nonprofit organizations certified by the U.S. Olympic and Paralympic Committee to govern specific amateur sports.) The section also adds definitions to 36 U.S.C. §220501(b) of "sex" (a person's immutable biological classification as male or female), "male" (a person with the biological function, at conception, of producing sperm), and "female" (a person with the biological function, at conception, of producing eggs).

This section requires a national governing body (NGB), subject to sex-based eligibility standards under section 220522(20), to continue sanctioning amateur athletic competitions in its sport that (1) meet existing sanctioning requirements, (2) are solely for males or solely for females, and (3) were (or are successors to) competitions sanctioned by the NGB in the 10-year period prior to enactment. It prohibits an NGB from rescinding sanctioning or altering sex-based competition categories for any such previously sanctioned event not yet held as of enactment (except to comply with section 220522(20)). This subsection does not prohibit sanctioning competitions open to both males and females.
