H.R. 7453 — CLEAN Act

This section denies the premium tax credit for coverage under a qualified health plan (i.e., the Affordable Care Act's premium tax credit subsidizing insurance purchased through exchanges) to any individual if such individual (or spouse, for a joint return) is a sex offender (as defined in section 111 of the Adam Walsh Child Protection and Safety Act of 2006) as of the last day of the taxable year. The denial applies to taxable years ending after the date of enactment.

This section prohibits federal Medicaid payments for medical assistance provided to sex offenders (as defined in section 111 of the Adam Walsh Child Protection and Safety Act of 2006) by adding a new ineligibility category under SSA section 1903(i)(28) and permits states to elect not to provide such assistance (notwithstanding other Medicaid plan requirements), effective for individuals enrolled or reenrolled on or after the date of enactment.
