H.R. 747 — Stop Chinese Fentanyl Act of 2025

This section expresses the sense of Congress that the Government of the People's Republic of China should (1) work with the United States to identify unregulated chemicals used to create precursor chemicals that bear increased scrutiny; (2) require proper labeling of chemical and equipment shipments in accordance with international rules; (3) immediately implement "know-your-customer" procedures for chemical shipments; and (4) direct relevant departments and agencies—including the National Narcotics Control Commission, Ministry of Public Security, General Administration of Customs, and National Medical Products Administration—to establish and swiftly enforce new rules to crack down on precursor trafficking.

This section revises the definition of "foreign opioid trafficker" under the Fentanyl Sanctions Act to include (1) any entity of the People's Republic of China (PRC) that the President determines produces, manufactures, distributes, sells, or knowingly finances or transports synthetic opioids, listed chemicals that are synthetic opioids, or chemicals used to produce synthetic opioid controlled substances and fails to take credible steps—such as know-your-customer procedures or cooperation with U.S. counternarcotics efforts—to detect or prevent opioid trafficking; and (2) any senior PRC government official or other Chinese political official with significant regulatory or law enforcement responsibilities over such an entity who aids and abets opioid trafficking, including through intentional inaction. The section further amends the trafficker identification requirements to direct the President to consider, among other factors, whether the heads of the PRC National Narcotics Control Commission, Ministry of Public Security, General Administration of Customs, or National Medical Products Administration qualify as foreign opioid traffickers and to extend the period specified in section 7211(c) to 10 years (from 5 years).

This section amends the International Emergency Economic Powers Act (IEEPA) to impose new requirements on the President's exercise of authorities during covered national emergencies (i.e., those declared within the prior five years regarding international drug trafficking and not yet terminated), as follows: (1) requires the President to submit annual written evaluations to specified congressional committees (i.e., House Foreign Affairs, Financial Services, and Oversight and Government Reform Committees; Senate Homeland Security and Governmental Affairs, Foreign Relations, and Banking, Housing, and Urban Affairs Committees) assessing the effectiveness of such authorities, incorporating public- and private-sector stakeholder views, and discussing potential changes; (2) directs IEEPA consultations and reports to those committees (replacing reports to Congress generally); and (3) requires the President, when issuing related regulations, to consider costs and benefits of alternatives, evaluate them for expeditious emergency resolution, establish termination criteria, and explain in the regulations' basis and purpose how they will resolve the emergency. (IEEPA authorizes the President to impose economic sanctions, block property, and regulate foreign-exchange transactions, among other actions, during declared national emergencies involving threats from abroad.)

This section exempts the importation of goods from sanctions authorities and requirements under this Act. The section defines "good" as any article, natural or manmade substance, material, supply, or manufactured product (including inspection and test equipment but excluding technical data).
