H.R. 7470 — Keep ICE Out of Washington County, Maryland Act

This section states seven congressional findings regarding immigration detention and holding facilities operated by U.S. Immigration and Customs Enforcement (ICE). The findings address (1) the facilities' impacts on surrounding communities' public health, housing, infrastructure, and local services; (2) ICE's detention of citizens and noncitizens without due process; (3) inhumane detention conditions; (4) routine denials of medical care, access to counsel, and family visitation; (5) the local nature of land-use planning and community development; (6) concerns raised by residents and officials in Washington County, Maryland, about siting a federal immigration detention facility there; and (7) Congress's authority to condition or prohibit the use of federal funds and facilities.

This section prohibits the Department of Homeland Security (DHS), including U.S. Immigration and Customs Enforcement (ICE), from establishing, operating, expanding, or reopening any detention or holding facility—used primarily for the civil detention or holding of noncitizens—in Washington County, Maryland, and bars the obligation or expenditure of appropriated funds for such purposes. It grants standing to enforce the prohibition, via declaratory or injunctive relief in the U.S. District Court for the District of Maryland, to any resident of the county, the county government, a Member of Congress, or the State of Maryland.
