This section prohibits the Director of the Office of Personnel Management (OPM), Special Counsel, Director of the Office of Government Ethics (OGE), or Archivist of the National Archives and Records Administration (NARA)—or any individual acting in those positions—from simultaneously occupying or performing the duties of any other federal position. It further prohibits any individual occupying a Level I Executive Schedule position (i.e., 21 specified high-level positions including the Secretaries of State, Treasury, Defense, and others) or acting in such a position from simultaneously occupying or performing the duties of any other federal position. It also amends the Federal Vacancies Reform Act to prohibit directing any individual already performing acting duties in one office to perform acting duties in another vacant office.
