H.R. 75 — HOUSE Act of 2025

This section directs the Secretaries of Housing and Urban Development (HUD) and Agriculture (USDA) to (1) withdraw the final determination adopting energy efficiency standards based on the 2021 International Energy Conservation Code (IECC) for new construction and rehabilitation of HUD- and USDA-financed housing (89 Fed. Reg. 33112 (2024)); (2) prohibit implementation or enforcement of that determination or any substantially similar one using federal funds; and (3) revert to the pre-determination standards (i.e., 2006 IECC or ASHRAE 90.1-2004 for multifamily high-rises). (Thus, the standards apply to new construction of public and assisted housing, FHA-insured single-family and multifamily housing (excluding manufactured homes), USDA rural single-family housing, and HOPE VI-funded projects.) It further prohibits the Secretary of Veterans Affairs from implementing or enforcing similar determinations for VA-guaranteed housing loans and the Director of the Federal Housing Finance Agency from finalizing, implementing, or enforcing energy efficiency standards or rules for single- and multifamily housing. This section also amends the provision on consideration of state standards (42 U.S.C. 12709(d)) by adding a new condition requiring that not less than 26 states have adopted an energy efficiency code or standard meeting or exceeding a revised code before HUD and USDA must update federal standards.
