H.R. 755 — Critical Mineral Consistency Act of 2025

This section amends Section 7002 of the Energy Act of 2020 by (1) inserting "minerals or materials" after "critical" in subsection (c)(4)(C); (2) redesignating subsection (o) as subsection (p); and (3) inserting new subsection (o) to require the Secretary of the Interior to publish, not later than 45 days after enactment of the Critical Mineral Consistency Act of 2025, a unified Critical Minerals and Materials List that includes critical minerals designated by the Secretary under subsection (c) and critical materials (i.e., non-fuel minerals essential to energy technologies with supply chain risks) designated by the Secretary of Energy under subsection (a)(2) as of enactment. The new subsection further requires the Secretary to update the list not later than 45 days after any updates to those designations (with coordination between the Secretaries to the maximum extent practicable) and directs the Secretaries of the Interior and Energy, along with other relevant agency heads, to use the most recent list for administering programs involving critical minerals or materials. (Thus, the list harmonizes previously separate designations by the U.S. Geological Survey and Department of Energy to promote consistency across federal programs.)
