“To amend title 18, United States Code, to prohibit certain activities of immigration officers in connection with elections, and for other purposes.”
No CRS summary available for this bill.
This section extends the election interference prohibitions of 18 U.S.C. 593—which bar officers or members of the Armed Forces from prescribing voter qualifications, preventing qualified voters from exercising suffrage, compelling election officers to accept unqualified votes, imposing unauthorized election regulations, or interfering with election officers' duties (with penalties of fines, imprisonment up to five years, or both, and disqualification from federal office)—to immigration officers (as defined in section 101 of the Immigration and Nationality Act). The section further restricts immigration enforcement or removal operations during the four-week period before a federal election unless such operation is based on particularized criminal probable cause related to a particular individual or necessary to prevent imminent death or serious bodily injury.
