This section states the following congressional findings: (1) the People's Republic of China (PRC) presents a risk of infiltrating the U.S. energy grid; (2) energy storage systems manufactured in the PRC and imported to the United States can contain remote monitoring capabilities; (3) such capabilities provide the PRC access to the U.S. electric grid and the ability to interfere with critical infrastructure reliability; (4) the Secretary of Commerce, through the Bureau of Industry and Security, is responsible for import and export controls to strengthen U.S. national security; and (5) restricting imports of energy storage systems with remote monitoring capabilities is necessary to protect the U.S. energy grid.
This section prohibits the importation into the United States of any energy storage system (i.e., any device, module, or product capable of storing electric current for later discharge) containing remote monitoring capabilities (i.e., any device capable of observing, collecting, analyzing, and disrupting data of information technology, communication, or critical infrastructure systems) if manufactured using technology licensed or owned by (1) any entity organized under the laws of the People's Republic of China (PRC) or any jurisdiction within the PRC, or (2) any entity under the jurisdiction, control, authority, or oversight of the Chinese Communist Party (CCP). The section further (1) directs the Commissioner of U.S. Customs and Border Protection to issue enforcement regulations within 60 days of enactment, including mechanisms to identify covered products, and to conduct a review within 180 days and annually thereafter to determine whether to impose additional restrictions; (2) imposes criminal penalties of up to 5 years imprisonment, a fine of up to $250,000, or both, per shipment for knowing violations; and (3) requires the Secretary of Commerce, in consultation with the Secretaries of Energy and Homeland Security, to submit to the specified congressional committees (i.e., designated committees in the House and Senate on energy/commerce, foreign affairs/relations, and intelligence) a report on PRC-developed such systems in the United States within 180 days of enactment and annually thereafter through 6 years after enactment (with a possible classified annex).
