H.R. 7666 — SOS: Sustaining Outpatient Services Act

This section expands the definition of services paid under Medicare Part B's hospital outpatient prospective payment system (OPPS) to include, beginning in 2027, items and services furnished by an off-campus outpatient department of a provider (as defined in 1833(t)(21)(B)) if the greatest total amount paid under the physician fee schedule (PFS) to any physician specialty for such items and services during the prior year was less than $2 million. (As background, most off-campus outpatient departments established on or after November 2, 2015, are currently excluded from OPPS payments and instead receive lower PFS payments; thus, this change allows qualifying low-volume services to receive higher OPPS payments.)
