H.R. 7667 — TRICARE Fairness for National Guard and Reserve Retirees Act

This section revises TRICARE eligibility for members of the Retired Reserve (i.e., reserve component members qualified for non-regular retired pay at age 60 under 10 U.S.C. chapter 1223 but under 60 years of age) to limit coverage under 10 U.S.C. 1074(b)(2) and eligibility for TRICARE Retired Reserve (TRR, a premium-based health plan) under 10 U.S.C. 1076e(a) to those receiving such retired pay (or who would receive it but for VA disability pay offsets under 38 U.S.C. 5304 or 5305). (Thus, under-60 Retired Reserve members not receiving retired pay lose TRICARE and TRR eligibility.) The changes take effect 18 months after enactment.
